Terms of service

The rules of the road.

These Terms of Service ("Terms") govern your use of SmileSafe AI. By using our platform, you agree to these Terms. Please read them carefully.

1. Who can use SmileSafe

To use SmileSafe AI, you must be:

• At least 13 years old (or older, depending on local law). Users under 13 must have a parent or guardian present.
• Capable of forming a binding legal agreement
• Not prohibited from using SmileSafe under applicable law

If you are using SmileSafe on behalf of an organization (e.g. a host location for a kiosk), you represent that you have the authority to bind that organization to these Terms.

2. What SmileSafe is

SmileSafe AI is a digital platform that:

• Provides AI-based preliminary screening of dental health based on photos you submit
• Generates a screening report you can share with a dentist
• Helps you find and book appointments with verified independent dentists
• Provides verified dentists a dashboard to manage SmileSafe-originated patients

3. Your account

You may use some features of SmileSafe without an account. For features that require an account (such as a dentist's professional dashboard or saved patient history), you agree to:

• Provide accurate and current information
• Keep your login credentials confidential
• Notify us immediately if you suspect unauthorized access
• Be responsible for all activities under your account

4. Acceptable use

You agree NOT to:

• Use SmileSafe for any unlawful purpose
• Submit photos that are not of your own teeth (or photos of someone else without their consent)
• Submit fraudulent, misleading, or false information
• Attempt to access another user's account or data
• Reverse engineer, decompile, or attempt to extract our AI models
• Use automated tools (bots, scrapers) to access the platform
• Attempt to overload, disrupt, or damage our services
• Pose as a licensed dentist if you are not one
• Use SmileSafe to give medical advice to others

5. Your content and AI scans

You retain ownership of the photos you submit. By submitting photos, you grant SmileSafe AI a non-exclusive, worldwide, royalty-free license to:

• Process the photos through our AI to generate your screening report
• Store the photos as part of your scan history
• Share them with the dentist you book with (if you book)
• Use de-identified, aggregated versions to improve our AI (you can opt out — contact us)

You confirm that you have the right to submit any photos you upload.

6. Dentists in our network

Dentists in the SmileSafe network are independent licensed professionals, not employees of SmileSafe. SmileSafe verifies their credentials (NPI, state license) before approving them, but:

• SmileSafe does not provide dental services and does not guarantee specific outcomes
• SmileSafe is not responsible for the actions, advice, or treatment provided by any dentist
• The doctor-patient relationship is between you and the dentist you choose

7. Bookings and appointments

When you book an appointment through SmileSafe:

• The booking is a request — the dentist may need to confirm or reschedule
• Cancellation, rescheduling, and no-show policies are set by the dentist's practice. Please review them with the dentist directly.
• Payment for dental services is handled directly between you and the dentist's practice — SmileSafe does not process payments for treatment

8. Fees

Using SmileSafe AI for scans, booking, and finding a dentist is currently free for patients. Some kiosk hosts or partner clinics may charge a small fee — this will be clearly disclosed before you scan.

For dentists in our network, applicable fees and revenue-share arrangements (if any) are set out in your separate Partner Agreement.

9. Intellectual property

The SmileSafe platform, including its design, code, AI models, content, and brand, is owned by SmileSafe AI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or redistribute any part of the platform without our written permission.

10. Disclaimer of warranties

SmileSafe AI is provided "as is" and "as available", without warranties of any kind, either express or implied. We do not warrant that:

• The platform will be uninterrupted, secure, or error-free
• The AI screening will be accurate or complete
• Any specific dentist or appointment will be available
• Defects will be corrected

11. Limitation of liability

To the fullest extent permitted by law, SmileSafe AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or personal injury, arising out of or related to your use of the platform.

Our total liability to you for any claim shall not exceed USD $100 or the amount you paid us in the past 12 months, whichever is greater.

Some jurisdictions don't allow these limitations, so they may not apply to you in full.

12. Indemnification

You agree to indemnify and hold harmless SmileSafe AI, its founders, employees, and partners from any claims, damages, or expenses (including reasonable attorney's fees) arising from your misuse of the platform, your violation of these Terms, or your violation of any law or third-party right.

13. Termination

You may stop using SmileSafe at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our sole discretion. Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive (intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution) will continue to apply.

14. Changes to these Terms

We may update these Terms from time to time. If changes are material, we'll notify you by email or through the platform. Your continued use after the changes take effect constitutes acceptance of the new Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of SmileSafe will be resolved through good-faith negotiation first. If we can't resolve it within 60 days, the dispute will be settled in the state or federal courts located in Travis County, Texas.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
